1. General Terms

If you are purchasing products or services from South Wales Dental Sleep (SWDS), you agree to comply with the following terms and conditions. Please read them carefully before placing an order or booking an appointment. These terms apply to all products and services offered by SWDS, including the Mandibular Advancement DeviceHome Sleep TestAirway ConsultationMyofunctional Therapy Consultations, and Online Myofunctional Therapy Treatment Packages.

2. Mandibular Advancement Device (MAD) Terms

2.1 Use of Device

  • This Mandibular Advancement Device (MAD) is custom-made for the individual named in the order and is intended for single-patient use only.
  • Sharing or transferring the device is strictly prohibited.
  • The device should be used under the guidance of a qualified healthcare provider who has recommended it as part of your treatment plan for sleep conditions.

2.2 Refund & Cancellation Policy

  • Non-returnable & Non-refundable: Due to the custom nature and hygiene standards for medical devices intended for oral use, we cannot accept returns or offer refunds once the order has been processed.
  • Cancellation: You may cancel your order within 24 hours of placing it without charge. After this period, cancellations will not be accepted as the device may already be in production.

2.3 Liability

  • Limitation of Liability: We do not accept liability for complications, injuries, or other adverse effects that may arise from the use of the MAD if it is not used in accordance with the instructions provided, or if it is used without adequate supervision by a healthcare professional.
  • Disclaimer: This device is intended as a treatment aid and not as a cure. Effectiveness can vary based on individual conditions and usage compliance. Please continue consulting with your healthcare provider about your overall treatment plan.

2.4 Data Protection

  • Data collected through the ordering process is strictly used for fabricating your custom device and will not be shared with third parties without your explicit consent, adhering to GDPR and applicable data protection laws.

2.5 Consent

  • By placing an order for the Mandibular Advancement Device, you confirm that you have read and agreed to these terms. You acknowledge that the device is made-to-orderand cannot be returned or refunded after production starts.

3. Home Sleep Test Terms

3.1 Use of Kit

  • The Home Sleep Test Kit is intended for the sole use of the individual named in the order. Sharing or transferring the kit is not permitted.
  • The kit is designed to aid in the diagnosis of sleep conditions and should be used following the provided instructions.

3.2 Refund & Cancellation Policy

  • Non-returnable & Non-refundable: Due to the single-use and hygienic nature of the Home Sleep Test, we cannot accept returns or refunds once the kit has been shipped.
  • Cancellation: Orders can be cancelled within 24 hours of placement without charge. After this time, cancellations are not possible as the kit may be in transit.

3.3 Liability

  • Limitation of Liability: We are not responsible for inaccurate results caused by improper use of the kit or non-compliance with instructions.
  • Disclaimer: The Home Sleep Test is a diagnostic tool, not a treatment device. It should be used under the guidance of a qualified healthcare provider, who will interpret the results as part of your broader treatment plan.

3.4 Data Protection

  • All personal and health information collected during the ordering and testing process will be handled with strict confidentiality and used solely for the purpose of processing your order and improving our services, in compliance with GDPR and relevant privacy legislation.

3.5 Consent

  • By ordering the Home Sleep Test, you confirm that you have read and agreed to these terms and consent to the use of your personal and medical information as necessary for providing the test and associated services.


4. Airway Consultation (In-Person) Terms

These terms apply to your Airway Consultation (in-person) with Dental Sleep. By booking, you agree to the terms below.

4.1 Minimum Notice Required

  • Minimum notice required: 24 hours (excluding weekends and public holidays).
  • When you book an appointment, we reserve our highly qualified clinicians’ time, equipment, and team resources exclusively for you. If you need to cancel or reschedule, please notify us as soon as possible. Weekends and public holidays are not included in this notice period.

4.2 Missed or Late-Cancelled Appointments

  • If you miss an appointment or cancel/reschedule at short notice (less than the required notice period), your fee and/or deposit will be retained.
  • It is our policy to request full prepayment and/or deposits and to make an automatic charge should insufficient or no notice of cancellation be given.

4.3 Late Attendance

  • If you are running late, please call us as soon as possible. Your clinician will determine whether there is enough time to proceed.
  • If insufficient time remains, you will need to reschedule and a late cancellation fee will apply.
  • If your clinician can see you, your appointment may need to be shortened to avoid delaying other patients.
  • If additional time is required to complete assessment or related work, an additional feewill apply.
  • If you do not attend without sufficient notice, a failure-to-attend fee will apply and some or all of your deposit may be lost.

4.4 Changing Your Mind

  • Should you change your mind before treatment has begun and within the cancellation period, no fees will be payable and any refundable deposits will be returned.
  • Where a change of mind arises after consent has been given or during or after treatment, all time allocated will be charged based on clinician/surgery time.
  • Where third parties are involved (e.g., laboratories, materials), all fees will remain payable in full.

5. Myofunctional Therapy Consultation (In-Person) Terms

These terms apply to your Myofunctional Therapy Consultation (in-person) with Dental Sleep. By booking, you agree to the terms below.

5.1 Minimum Notice Required

  • Minimum notice required: 24 working hours (weekends and public holidays are not included in the notice period).
  • When you book an appointment, we reserve clinician time, equipment, and team resources exclusively for you. Please notify us as soon as possible if you need to cancel or reschedule.
  • Examples (to avoid doubt):
  • A Monday 10:00 appointment must be cancelled/rescheduled by the previous Friday 10:00.
  • A Tuesday 14:00 appointment must be cancelled/rescheduled by Monday 14:00 (assuming Monday is not a public holiday).
  • If a public holiday falls within the notice period, the deadline moves to the last time that still provides 24 working hours.

 

5.2 Missed or Late-Cancelled Appointments

  • If you miss an appointment or cancel/reschedule with less than the required notice, your fee and/or deposit will be retained.
  • It is our policy to request full prepayment and/or deposits and to make an automatic charge should insufficient or no notice be given.

5.3 Late Attendance

  • If you are running late, please contact us as soon as possible. Your clinician will determine whether there is enough time to proceed.
  • If we cannot proceed, you will need to reschedule and a late cancellation fee will apply.
  • If we proceed, the session may be shortened to avoid delaying other patients.
  • If additional time is required to complete therapy, a further appointment and additional fee may be required.

5.4 Changing Your Mind

  • Should you change your mind before treatment has begun and within the cancellation period, no fees will be payable and any refundable deposits will be returned.
  • Where a change of mind arises after consent has been given or during or after treatment, all time allocated will be charged based on clinician/surgery time.
  • Where third parties are involved (e.g., laboratories, materials), all fees will remain payable in full.

6. Online Myofunctional Therapy Treatment Package Terms

These terms apply to your Online Myofunctional Therapy Treatment Package (remote video sessions) with Dental Sleep. By purchasing and booking sessions, you agree to the terms below.

6.1 Minimum Notice Required

Minimum notice required per session: 24 working hours (weekends and public holidays are not included in the notice period).

  • Examples (to avoid doubt):
  • A Monday 10:00 online session must be cancelled/rescheduled by the previous Friday 10:00.
  • A Tuesday 14:00 online session must be cancelled/rescheduled by Monday 14:00 (assuming Monday is not a public holiday).
  • If a public holiday falls within the notice period, the deadline moves to the last time that still provides 24 working hours.

 

6.2 Missed or Late-Cancelled Sessions

  • If you miss a session or cancel/reschedule with less than the required notice, the session will be forfeited and/or your fee/deposit retained (as applicable).
  • It is our policy to request full prepayment and/or deposits and to make an automatic charge should insufficient or no notice be given.

6.3 Patient Responsibility for Technology and Readiness

For online therapy, it is your responsibility to ensure:

  • A sufficient Wi-Fi/internet connection.
  • A fully charged laptop or tablet with a working camera and microphone.
  • quiet, safe environment suitable for exercises.

Failure to meet these requirements may result in the session being forfeited in accordance with the time-loss rules below.

6.4 Late Starts, Technical Failures, and Loss of Session Time

Your session time is reserved exclusively for you and starts at the scheduled time. We cannot extend the session beyond the scheduled end time. The following time-loss rulesapply to patient-side issues (e.g., poor Wi-Fi, device not charged, login delays, unsuitable environment):

  • 0–10 minutes lost: session proceeds; no extension beyond the scheduled end time.
  • 11–20 minutes lost: session proceeds if clinically useful; lost time is forfeited.
  • More than 20 minutes lost: the session may be deemed not deliverable and will be forfeited in full.

6.5 Late Attendance (Online)

  • If you are running late, contact us as soon as possible. We will do our best to continue, but the session will still end at the scheduled time and lost time cannot be carried over.

6.6 Changing Your Mind

  • Should you change your mind before treatment has begun and within the cancellation period, no fees will be payable and any refundable deposits will be returned.
  • Where a change of mind arises after consent has been given or during or after sessions have commenced, all time allocated will be charged based on clinician/surgery time.
  • Where third parties are involved (e.g., laboratories, materials), all fees will remain payable in full.

7. Website Terms

7.1 Intellectual Property

  • All content on this website, including text, images, and logos, is the property of South Wales Dental Sleep and is protected by copyright laws. Reproduction or distribution without permission is strictly prohibited.

7.2 Limitation of Liability

  • While we strive to provide accurate information, South Wales Dental Sleep will not be liable for any errors, omissions, or damages arising from the use of this website or its content.

7.3 Modifications

  • We reserve the right to modify these Terms and Conditions at any time. Changes will be posted on this page, and your continued use of the site signifies acceptance of these changes.
